The petitioner's tribe claim is still pending before the second respondent committee as the petitioner claims that he belongs to Thakur Scheduled Tribe. His tribe certificate dated 21.01.2002 (Annexure 'A') was utilized for claiming the benefit and as set out in the petition. The petitioner, before this benefit can be entirely availed, should obtain the certificate of validity from the competent Scrutiny Committee. Since 11.06.2006, the proposal is pending with the respondent no.2. The petitioner was eligible for being considered for appointment against a reserved seat, that is how the petitioner was appointed and his claim was forwarded to the Scrutiny Committee and since it was not decided for a long time, we called upon the learned A.G.P. to take instructions.

Shri D.R. Kale, on taking instructions informs us that the Scrutiny Committee will dispose of the pending claim as expeditiously as possible and within a period of four months from the date of receipt of a copy of this order.

We only note the argument of Mr. Deshmukh that, the petitioner's paternal aunt has been granted a certificate of validity, that was relying upon the certificate of validity issued to the petitioner's father. We have no doubt in our mind that the committee will take due note of this grant and the submissions based thereon while deciding the matter finally.

The writ petition is, therefore, disposed of with the above directions.
