Heard the the learned counsel for applicant and the learned APP at length.

When this Court expressed disinclination to grant any relief to the applicant, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application. Leave granted. The bail application stands disposed of as withdrawn.

From the report and the papers of investigation, it appears that the applicant is a child of 15 years of age and he is addicted to

prohibited drugs and because of that three crimes have been committed by him are as follows:

a) Crime No.34 of 2024, for the offence punishable under Section 399 read with Section 34 of the Indian Penal Code and Section 3/25 of the Arms Act, 1959 ; b) Crime No.289 of 2024, for the offences punishable under Sections 118(2), 352, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023 ; and c) Crime No.22 of 2025, for the offences punishable under Sections 311, 111, 74, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023.

As per the report (FIR) and say filed by the investigating officer, it appears that the applicant is suffering from mental illness as defined under Section 2(1)(s) of the Mental Healthcare Act, 2017. Therefore, it is necessary to examine him through the psychiatric and after receiving of the report of his mental illness as per the Mental Healthcare Act, he shall be treated in the rehabilitation centre, as held and directed by this Court in Bail Application No.740 of 2025 (Pramod Wamanrao Dhule Vs. The State of Maharashtra and another) dated 25th September, 2025. The intimation of his treatment shall be given to his parents from time to time. As soon as the applicant recovers from that illness, he can file the application for bail before the Juvenile Justice Board.
