IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD MISC. CIVIL APPLICATION NO. 120 OF 2014 Shanta Gulabrao Kolte

Versus

Gulabrao Gangadhar Kolte.

--- Mr. S.S. Kulkarni, Advocate for the applicant. CORAM : N.W. SAMBRE,J.

DATE : 31st JULY, 2015.

PER COURT:

1] Heard.

2] The applicant claims to have been married on 28.5.2010 with the non applicant and started residing at Jalna. It is claimed that she was ill-treated and she was driven out from her matrimonial house, which resulted into filing a petition for restitution of conjugal rights. The applicant is unemployed and staying with her parents at Jalna. She is also having ill health.

3] The non-applicant though served has not appeared. Keeping in view the fact that the pleadings in the application are not controverted, hardship that is expressed will have to be accepted and it prompts this Court to pass an order, allowing the application in terms of prayer clause (B). The application is accordingly disposed of.

[N.W. SAMBRE] JUDGE.
