The learned Counsel for the petitioner, on instructions seeks leave to withdraw this Writ Petition. The learned Counsel submits that the petitioner would avail the alternate remedy of filing the private complaint before the Magistrate for which liberty may be granted.

Criminal Writ Petition is disposed of as withdrawn. It is for the petitioner to file the complaint before the Magistrate, for which the liberty of this Court is not required.

Upon filing such complaint, it is for the concerned Magistrate to consider the said complaint on merits and pass the appropriate orders in connection with the complaint.

We have not considered this Writ Petition on merits. All points are kept open.
