Heard the learned counsel for petitioner.

The petitioner claims pay scale of trained hostel superintendent. Mr. Patil, learned counsel for petitioner submits that the petitioner is entitled for the pay scale of 4500 - 7000 instead of 4000 - 6000 as the petitioner possesses HSC qualification and the same is sufficient for the post of hostel superintendent. We have heard the learned AGP and the following order is passed:

O R D E R

a.

The petitioner is allowed to make representation to respondent Nos. 1 to 3, within a period of four weeks

from today for reliefs prayed for in this petition. It is open to the petitioner to annex copy of the present writ petition to his representation, so also to rely upon the Judgment of this Court in Writ Petition No. 1491 of 2001, in support of his claim.

If the representation is made by the petitioner within the stipulated time, respondent Nos. 1 to 3 shall consider and decide the same as expeditiously as possible and preferably within a period of twelve weeks from the date of receipt of the representation. c.

If, for any reason, respondent Nos. 1 to 3 are not inclined to allow the representation of the petitioner, they shall grant an opportunity of being heard to the petitioner.

d.

It is needless to mention that if the petitioner's representation is allowed, the payment, as prayed for, be made, within a period of six months from the date of decision.

e.

We hope, respondent Nos. 1 to 3 shall communicate their decision to the petitioner immediately

after passing an order on their representation. f.

The writ petition is disposed of in terms of this order. No order as to costs.
