CIVIL APPLICATION NO. 9708 OF 2023 1.

This is an application whereby the applicant seeks to intervene in the present petition filed by the petitioner who challenging the order of respondent - Scrutiny Committee whereby validity certificate issued to the petitioner was cancelled.

It is an admitted position that the Scrutiny Committee passed the impugned order on the complaint filed by applicant No.1. Since the proceeding before respondent - Scrutiny Committee was initiated on complaint filed by applicant No.1, the petitioner herein ought to have joined the applicant No.1 as a party respondent to this petition. There is

2 909 WP 9459-2023.odt no explanation why the applicant No.1 was not added as party respondent. We are convinced that the application deserves to be allowed in the interest of justice.

Hence, the application is partly allowed and the petitioner is directed to join applicant No.1 as a party respondent. 4.

Amendment be carried out within two (2) weeks from today. 5.

The newly added respondent (applicant No.1) in this application is granted time of three (3) weeks to file reply affidavit. 6.

List Writ Petition No. 9459 of 2023 on 31.07.2025. 7.

Leave is also granted to the petitioner to place on record last page of impugned order of the respondent - Scrutiny Committee at Exhibit - I within two (2) weeks from today.
