Heard learned counsel for the applicant and learned APP for the State.

This is a successive bail application of the applicant in Crime No.528 of 2022 registered with MIDC Waluj Police Station, District Aurangabad for the offences punishable under Sections 302, 307, 294, 323, 504, 506 r/w 34 of the Indian Penal Code. 3.

The applicant seeks bail on the ground of parity. His counsel referred to the order of this Court dated 10.01.2024 passed in Bail Application No.1749 of 2023 granting bail to the co-accused, who has played identical role in the alleged crime. 4.

The Court has gone through the papers and role attributed to the applicant with co-accused Yogesh Bhausaheb Dalvi while releasing him on bail. Perusal of the record reveals that the role

947-ba-1483-2024.odt (2) of the applicant is identical to the role attributed to co-accused Yogesh. Since the co-accused has been granted bail subsequently, the applicant deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Bhausaheb Damodar Dalvi, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that;

(a) The applicant should not tamper with the prosecution witnesses.

(b) The applicant should not enter Ranjangaon (Shenpunji), Tq. Gangapur, District Chhatrapati Sambhajinagar (Aurangabad) till conclusion of the trial.
