It is submitted that the validation proceeding in respect of the caste claim of the petitioner is pending since the year 2013, is not yet decided. The learned counsel submits that the respondent No. 3 is not giving admission to the petitioner to the 4th year, only on the ground that his validation proceeding is pending.

In case, the validation proceeding in respect of caste claim of the petitioner is pending with respondent No. 2, then the respondent No. 2 shall decide the same on its own merits, in accordance with law, expeditiously and preferably within four months from the date of appearance of the petitioner.

The petitioner shall appear before the Committee on 1/2

In case, the petitioner is otherwise eligible, then the respondent No. 3 shall not prevent the petitioner from taking admission in 4th year only on the ground that his validation proceeding is pending.

Writ petition is disposed of. No costs.
