Heard the learned Advocate representing the respective parties. By the present petition the petitioners are challenging the rejection of application Exhibit 5 by both the Courts below i.e. Trial Court and so also by the Appellate Court. He submits that the order passed by the Mamlatdars' Court is executed and nothing further would survive as regards the interim application is concerned. 2.

The learned Advocate for the petitioners submits that since his property through which the road is granted is a personal property, the suit be expedited.

Having regard to the facts and circumstances of the case, Civil Suit No.415 of 2021, pending before the learned Civil Judge, Senior Division, Ahmednagar is expedited. The learned Civil Judge, Senior Division, Ahmednagar is directed to decide the suit as expeditiously as possible, and in any way, within a period of three years from the date of receipt of this order.
