The applicant seeks bail in Crime No.22 of 2023 registered with Kasoda Police Station, District Jalgaon for the offences punishable under Sections 302, 120(B) r/w 34 of the Indian Penal Code and Sections 4/25 of the Arms Act.

The applicant was not named in the FIR. It is submitted that he was just arraigned as an accused on suspicion. There was no material investigation against him. Similarly situated co-accused namely Samadhan, Akshay, Shubham, Manoj and Pradeep have been granted bail. The role attributed to the applicant is identical to the role attributed to the above co-accused, who have been granted bail. Hence, he deserve parity. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Abdul Rehaman Mohammad Avesh, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that he should not tamper with the prosecution witnesses and should attend the trial on each and every date.
