915 WRIT PETITION NO. 8971 OF 2016 BHARTIYA GRAMIN PUNARRACHANA SANSTHA AURANGABAD THROUGH ITS AUTHORISED SIGNATORY V.K. MATHPATI

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER ...

Advocate for Petitioner : Mr. S.S. Thombre AGP for Respondents: Mr. S.B. Pulkundwar ...

CORAM : R. M. BORDE & K. K. SONAWANE, JJ.

Date: August 20, 2016 ...

PER COURT :- The petitioner is praying for issuance of directions to permit them to admit the students at the institutional level, thereby modifying the rules, framed by the authorities for admission of the students to technical courses for the academic year 2016-2017. It is contended that, the relaxation needs to be granted since the institution are not in a position to fill in even 50% of the seats. The directions as requested by the petitioner, need not be given in exercise of extraordinary jurisdiction under article 226 of the Constitution of India. It is for the experts, dealing with the academic matters to prescribe the minimum criteria for securing admission to various courses and the Courts do not possess expertise to deal with academic matters. For the reasons recorded above, the petition is devoid of merit and the same is dismissed.
