PER COURT :- 1.

Mr. Kulkarni, the learned counsel for the petitioner submits that respondent no.4 has not paid amount towards retiral benefit as directed by this Court, as such respondent No.4 has committed contempt of the order passed by this Court.

Learned counsel for respondent No.4 submits that petitioner has been paid amount of gratuity and leave encashment and some amount towards difference of 6th pay Commission is not paid, however, because of the weak financial condition of the Municipal Council, Jalna some time would be required to pay the remaining amount towards difference of 6th pay commission. 3.

It is not disputed that petitioner has received amount towards leave encashment and gratuity and some amount towards difference of 6th Pay commission is paid, however, not the total amount. 4.

Considering the difficulty shown by the learned counsel for respondent No.4, we pass following order.

O R D E R

The Respondent No.4 shall pay the remaining amount towards difference of 6th Pay Commission to petitioner within three months from today.
