Mrs Smita Joseph Ghodke v. The State Of Mah And ORS
8259.12WP IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD WRIT PETITION NO.8259 OF 2012 ...
MRS SMITA JOSEPH GHODKE
VERSUS
THE STATE OF MAH AND ORS.
...
Mr.S.B.Pulkundwar, AGP for the respondent/State ...
CORAM: S.S. SHINDE AND S.M.GAVHANE, JJ.
DATE : 24.02.2018 ORDER:
1] When the matter is called out, none appeared for the petitioner; therefore, the matter was kept back. Even on second occasion, none appears for the petitioner.
2] This Petition is pending from the Year 2012. However, the learned counsel appearing for the petitioner is not bothered to appear and argue the Petition. Even he did not bother to make arrangement to mention the matter for adjournment. In that view of the matter, the Petition is dismissed for want of prosecution.
3] However, we make it clear that if the petitioner has alternate efficacious remedy to take exception to the order impugned in this
8259.12WP Petition, the dismissal of this Petition shall not be construed as an impediment for availing of such appropriate remedy. However, we make it further clear that we have not expressed any opinion on merits of the contentions raised in the Petition or delay which would occur in presenting appropriate proceedings, in case the petitioner decides to do so.
