Heard the learned Counsel for the parties.

This application is filed for condonation of delay of 1869 days caused in filing the appeal by the employer against whom an order is passed by the learned Commissioner under the Employees Compensation Act directing to pay the penalty. The Respondent No.2 is the Insurance Company against whom the order is passed to pay compensation. The claimant has filed appeal for enhancement bearing

( 2 ) 40-CA-9712-2024 First Appeal No.169 of 2020. Same is pending for admission in this Court.

Considering the reasons in the application, delay stands condoned. Application is allowed. Office to register the appeal. FIRST APPEAL 1.

Issue notice to the Respondents, returnable on 24th January 2025. 2.

Learned Advocate Mr.Bodade waives service of notice for Respondent No.2.

CIVIL APPLICATION FOR STAY .

Till further order, the learned Commissioner under the Employees Compensation Act, Latur shall not disburse the amount of penalty to the claimant, if not already disbursed.
