It is an application moved by the applicant seeking modification of the order passed by this Court (Coram : Sunil K. Kotwal, J.) dated 26th April, 2019 to the extent of extending the time to furnish the undertaking and the solvent surety/security/bank guarantee of any nationalized bank. 2.

Heard Mr G.S. Khaire holding for Mr S.S. Dande, learned counsel for respondent No.1 and Mr S.G. Sangle, learned AGP for respondent Nos. 2 and 3.

It would be just and appropriate to extend the time to furnish the undertaking as well as solvent surety/security/bank guarantee so that applicant may withdraw the amount.

ORDER

(i) The application is hereby allowed.

2 902-CA-11797-2021 (ii) Four weeks time is hereby extended to furnish undertaking as well as solvent surety/security/bank guarantee of any nationalized or scheduled bank in the like amount as per the order passed earlier by this Court in Civil Application No. 1493/2019 dated 26th April, 2019. (iii) The order dated 26th April, 2019 stands modified to the above extent. (iv) Registry to accept the undertaking as well as solvent surety/security/ bank guarantee as per the order passed by this Court dated 26th April, 2019 from the applicant, if the applicant furnishes the same within four weeks.
