Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner assails the order dated 25.04.2023 passed by the learned District Collector, Latur under Rule 107 of the Maharashtra Co-operative Societies Act, 1961, whereby the District Collector has directed to attach the property of the petitioner. As far as the order passed by the District Collector is concerned, there is no any provision of giving an opportunity of hearing to the concerned.

As far as the contention of Mr. Patil, learned counsel for the petitioner that before the attachment order, the petitioner filed an application before the liquidator on 18.01.2023, but the fact remains that this application was filed on 18.01.2023 and thereafter, the Collector passed the order. As now, the consequential and final order

976-wp-10671-2023.odt (2) is passed under Rule 107 of the MCS Act, I am not inclined to entertain the present petition.

In view thereof, writ petition is dismissed. No order as to cost.
