In respect of Criminal Appeal No. 359 of 2017 filed by accused Umesh Ishwar Patil, it appears that, he had engaged Advocate Mr. Z. M. Avhad to represent him. However, that accused had already filed Criminal Appeal No.475 of 2016. Now, Advocate Z. M. Avhad is placing on record an application, which is marked at Exhibit 'X'. It is appended with a photocopy of a letter, which he has received from the appellant dated 04.08.2023. Taking into consideration the tenor of the said letter we could gather that he wants to pursue his Criminal Appeal No.475 of 2016 and not Criminal Appeal No.359 of 2017.

Under such circumstance, Criminal Appeal No.359 of 2017 stands disposed of as withdrawn. Appearance of Advocate Mr. Z. N. Avhad is discharged.
