.
Applicants are seeking withdrawals of amount of Rs.19,82,619/- Rs.9,12,005/- and Rs.19,03,314/-. Learned counsel for the respondents vehemently opposed the applications. It is contended that these appeals need to be treated separately because in these appeals the amount of compensation is not meager but substantial.
2 968(ii).CA-8604-2025.odt 2.
I have considered rival submissions of the parties. Normally, this Court permits the claimants to receive entire amount on furnishing undertaking but in those cases where the amount were meager. In these appeals, the amounts are substantial in nature. I propose to disburse the entire amount on condition of furnishing undertaking to the extent of 75% and remaining 25% on furnishing solvent surety/security.
3.
Civil applications are partly allowed by permitting the applicants to receive the amount of compensation with accrued interest to the extent of 75% by furnishing undertaking and balance 25% on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court.
