The petitioners have filed proceedings U/Sec. 257 of the Maharashtra Land Revenue Code after five years. The learned counsel submits that, as per the proviso to sub section 1 of Section 257 of the M. L. R. Code, the proceedings after five years cannot be accepted except with the previous permission of the State Government.

The Sub Divisional Officer has communicated the State Government on 08th March, 2019 and on 03.05.2019 for the guidance and the necessary sanction, but the State Government has not responded.

The learned Assistant Government Pleader accepts notice

The State Government shall take decision on the proposal moved by the Sub Divisional Officer, Shirdi on 08.03.2019 and 03.05.2019 (Exhibit 'G' and 'I') expeditiously and preferably within a period of three (03) months from today. 4.

In view of the above, the writ petition is disposed of. No costs.
