Learned counsel Mr. Bhokarikar for the appellant/claimant along with appellant and the learned counsel Mr. Choudhari for the respondent No. 2/Insurance company are present today before panel.

They tender terms of compromise on record. Same is taken on record and marked as Exhibit 'X' for identification. 3.

With the assistance of the learned counsel we have ascertained identity of the parties.

As per the agreed terms of compromise, the respondent No. 2/Insurance company shall deposit additional amount of Rs. 3,50,000/- towards full and final settlement in M. A. C. T. Jalgaon within a period of six (06) weeks from today. Same shall be taken as an undertaking. On depositing the amount, the appellant shall be at liberty to withdraw the same along with accrued

The first appeal is disposed of in terms of settlement at Exhibit 'X' and minutes of the order passed today. 6.

The court fees be refunded as per rules.

Award be drawn up accordingly.
