Heard the learned Advocates for the parties.

The Applicants have filed this Anticipatory Bail Application as they apprehend arrest. The proceedings relate to C.R.No. 0351/2024. The First Information Report (for short "FIR") is lodged on 21 July 2024 at 19.14 hours by the Mondha Police Station, Dist. Parbhani. The occurrence of the alleged offence is stated between 10 July 2015 to 23 January 2024. The Informant is one Sk. Khaja s/o Jameel Mohiyoddin, a private person stated to be the

- 2 - President of Azad Welfare and Education Society. The alleged offences are under Sections 409, 420, 465, 468, 470, 471, 120-B r/w 34 of the Indian Penal Code (for short 'IPC'). 3.

The learned Advocate for the Applicants and the learned APP agree that the facts and circumstances in this Application are identical to that in Anticipatory Bail Application No. 1811/2024 where substantial order has been passed. Interim order dated 21 October 2024 is hereby continued.

Considering the above, the following order in this Application which also deserves to be allowed, would meet the ends of justice :-

ORDER

(i) In the event of arrest of the applicants in connection with C.R. No. 0351/2024, registered with Mondha Police Station, Dist. Parbhani, for the offences punishable under Sections 409, 420, 465, 468, 470, 471 120-B r/w 34 of the IPC, the applicants are directed to be released on bail on furnishing PR bond in the sum of Rs. 15,000/- (Rupees Fifteen Thousand Only) each with one solvent surety in the like amount.

(ii) The applicants shall attend the concerned Police Station as and when required till filing of the chargesheet. They are further directed to co-operate the investigation.

- 3 - (iii) The applicants shall furnish details of residential address and other contact details such as the mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately informed to the concerned police station. (iv) The applicants shall not leave the jurisdiction of the Court without prior permission of the Court, until further orders.

(v) They shall not contact and/or influence the witness/es and/or tamper with the evidence in any manner whatsoever.

ABA is allowed in above terms.

Needless to mention the above observations are prima facie and limited to the adjudication of this ABA.
