The learned Counsel for the petitioners submits that the application filed by the petitioners under section 28-A of the Land Acquisition Act is pending with respondent No.2 since the year 2013. The same is not decided.

In case, the application is filed u/s. 28-A of the Land Acquisition Act by the petitioners and if the same is pending with respondent No.2-the Sub-Divisional Officer-Special Land Acquisition

2 W.P. No. 14826/2019 Officer, Paithan-Phulambri, office at Aurangabad, (Page 28), then the respondent No.2 shall decide the same on its own merits, in accordance with the law, expeditiously and preferably within a period of nine months, after hearing all parties concerned. 3.
