Both these applications are filed for grant of regular bail in connection with Crime No.76 of 2025, registered with Paithan Police Station, District Aurangabad (Rural), for the offences punishable under Sections 103(1) and 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.
The informant averred in the report that her son Amol was having wife Puja, daughter Sakshi and son Yuvraj. Amol was addicted to the liquor. He was doubting the character of his wife. Therefore, his wife was residing with her parents. Amol was serving as a waiter in the hotels. On 14th March, 2025 at about 08:00 am, Amol was present at home when the informant left for her daily work. When she returned home after some time, Amol was not found there. When she asked to Sakshi as to where is Amol, Sakshi said that Amol had left the house around 08:30 am. On 15th March, 2025, the friends of Amol, namely Sandeep Khirsagar and Sonu Jadhav, took search for Amol and then found that Amol was lying in the Nala adjacent to Sant Dnyaneshwar Udyan (Garden). His dead body was brought to the hospital.
Postmortem was conducted and it was revealed that Amol was throttled. Therefore, the report was lodged on 16th March, 2025. The learned Advocates for the applicants submitted that the applicants are falsely implicated in the crime. They have roots in the society and they will not flee away from the trial. Trial will take a long period. There is no direct evidence against these applicants. It is lastly prayed to allow the both the applications.

Perused the charge-sheet, particularly, the report (FIR), postmortem report and the statements of the witnesses. Applicant - Chandrakala is 60 years old woman. The applicants have roots in the society and they will not flee away from the trial. Trial will take a long period. Charge-sheet is filed. Considering all these reasons, without adverting to the facts of the case, it would be proper to release both the applicants on bail on certain conditions on the principle that bail is rule and jail is exception. Hence, the following order:-

Both the bail applications are allowed.
II.
Both the applicants in connection with Crime No.76 of 2025, registered with Paithan Police Station, District Aurangabad (Rural), for the offences punishable under Sections 103(1) and 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita, be released on bail on
furnishing personal bond of Rs.15,000/- each with one surety each of the like amount on following conditions:- a) The applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.
