IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 10727 OF 2018 GANGADHAR SAKHAHARI JADHAV AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for the Petitioners : Shri V. V. Tarde AGP for Respondent Nos. 1 to 5 : Shri K. S. Patil ...
CORAM : RAVINDRA V. GHUGE, J.
DATED : 26th SEPTEMBER, 2018.
...
PER COURT :
1.
The petitioners are aggrieved by the order dated 11/07/2018 passed by the Principal Secretary and the Special Officer on duty under Section 257 of the MLR Code. 2.
The learned Advocate for the petitioners has strenuously criticized the impugned order. On the basis of 15 (fifteen) grounds formulated in the memo of the petition, he has drawn my attention to the report of the Deputy Superintendent of Land Records, dated 27/02/2013 and the order of the learned District Superintendent of Land Records-cum-Deputy Director Land Records, Nashik dated 10/04/2013.
935-wp-10727-18.odt 3.
On perusing the above stated documents and upon going through the impugned detailed order dated 11/07/2018, I find that the revisional authority has rightly directed the Deputy Director of Land Records to cause a fresh enquiry in the matter, issue notices to all the interested parties, to conduct a proper enquiry and after considering the entire record available, in a careful manner, he would pass a reasoned order. I do not find that the said direction could be termed as being perverse or erroneous.
4.
Considering the above, this petition, being devoid of merit is, therefore, dismissed.
