The learned advocate for the applicant has placed on record order passed below Exh. 1 in Criminal Misc. Application No. 704/2019 by the Judicial Magistrate First Class, Dhule recording that said application is withdrawn as in the meantime the Family Court, Dhule has passed a decree of divorce between the parties. The applicant therefore, sought withdrawal of the Criminal Misc. Application today. She submits that, in view of the same, now even the petition which is sought to be transferred i.e. HMP No. 50/2019 filed for restitution of conjugal rights has become infructuous. She has received instructions to withdraw the present application.
