IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.10580 OF 2018 (Gangadhar Lalaba Narwade Vs. The Additional Divisional Commissioner and others) Mr.U.B.Deshmukh, Advocate for the petitioner. Mr.S.R.Yadav, AGP for respondent Nos. 1 and 2. ( CORAM : Ravindra V.Ghuge, J.) DATE : 24/09/2018 PER COURT :

1.

The petitioner has challenged an ad-interim order passed by the Additional Divisional Commissioner, Aurangabad on 04/08/2018, for two reasons. Firstly, that though the issue before the said authority is with regard to the conduct of respondent/Sarpanch in withdrawing money from the Gram Panchayat account for himself which is covered under Section 14(1) (g) of the Maharashtra Village Panchayats Act, the Authority has presumed that the issue is about misappropriation. Secondly, though the final arguments in the proceedings have been concluded by the litigating sides on 29/08/2018, the concerned Authority has still not delivered his order in the appeal filed by the Sarpanch who was disqualified by the Collector u/s 14(1)(g). khs/SEPT.2018/10580-d

2.

Learned AGP appearing on behalf of respondent Nos. 1 and 2 submits that there is no reason for respondent No.1 to delay his order and as the hearing is concluded on 29/08/2018, the order can be expected shortly.

3.

Considering the above, this petition is disposed off. It is expected that respondent No.1 shall deliver his order in the appeal which he has closed for orders, on or before 15/10/2018.
