The Petitioner's father Ravsaheb was working as Peon in Respondent No.3 / School. He was a permanent employee. He passed away on 05.01.2011, while in service. His widow applied on 25.01.2011, seeking compassionate appointment. On 31.05.2019, a Lab Attendant Mr. Vilas Daulat Pardeshi, opted for a voluntary retirement.

Considering the education of the Petitioner, he was accommodated on the said post on compassionate basis, on 01.06.2019. The

2 wp 9330.2022 Petitioner is unaware as to what happened to the application moved by the mother. He, however, submits that there is no dispute between the family members on this count.

The learned Advocate for the Management submits that as a vacancy arose due to the voluntary retirement of Mr. Pardeshi and the Petitioner was eligible, he was granted compassionate appointment on account of the death of his father.

The Petitioner and the Management submitted that though the appointment order of the Petitioner mentions 3 years as a probationary period, the Petitioner is still in employment. 5.

Considering the above, this Petition is disposed off with a direction to the Education Officer (Secondary), Zilla Parishad, Dhule to consider the proposal dated 15.11.2019, forwarded by the Management for seeking approval to the compassionate appointment of the Petitioner, as

3 wp 9330.2022 expeditiously as possible and preferably, on or before 15.10.2022. The order shall be communicated to the Management and the Petitioner, expeditiously.

Needless to state, the Education Officer would consider the proposal on it's own merits and in the light of the record available and the Policies applicable.
