Learned counsel for the petitioner submits that the respondent has filed a First Appeal against the impugned award passed by the Reference Court thereby enhancing the compensation. That First appeal is pending before this Court and there is a possibility of favourable order for the petitioner. Therefore, learned counsel prayed for permission to withdraw the writ petition with liberty to move an application before the learned trial court, for restoration of the original Execution Petition No. 197 of 2012. 2] Considering the circumstances on record, leave is granted to withdraw the petition with liberty as prayed for. Writ petition is disposed of accordingly. No orders as to costs.
