Versus
The State of Maharashtra, through the Police Inspector, Supa Police Station, Taluka Parner, District Ahmednagar ..Respondent Mr V.D. Sapkal, Advocate for applicants Mrs M.A. Deshpande, A.P.P. for respondent Mr V.R. Langhe, Advocate assisting the A.P.P. CORAM : N.W. SAMBRE, J.
DATE : 14th September 2015 PER COURT Heard.
2.
The applicants No.2 and 4 are husband and wife whereas applicant No.3 is father of applicant No.4 - Shobha. The applicant Nos.1 and 5 are son and daughter of applicants No.2 and 4 and grandson of applicant No.3.
3.
All these applicants are seeking regular bail in Crime No.121/2015 registered on 21st July 2015 at Supa Police Station, District Ahmednagar for the offence, punishable under Sections 306, 342, 323, 504, 506 read with Section 34 of the Indian Penal Code. 4.
According to applicants, deceased Dnyaneshwar who was serviceman, has committed suicide, leaving behind a suicidal chit mentioning about the persons responsible for his suicide. 5.
The background appears to be that all the applicants were forcing said deceased Dnyaneshwar to marry applicant No.5 - Vidya and from the statements, it appears that the deceased Dnyaneshwar was in touch with Vidya.
6.
The applicants No.1, 2 and 3 were arrested on 30th July 2015 whereas applicants No.4 and 5 were arrested on 12th August 2015. 7.
I have perused the statement of Vaibhav, friend of deceased Dnyaneshwar who accompanied him to the place of Vidya in response to phone call from Vidya to deceased Dnyaneshwar, so also statement of one Pawar, a lawyer before whom the compromise was reduced into writing. Perusal thereof prima facie reflects that the deceased Dnyaneshwar was in two minds, whether to establish relation with the present applicants or not.
8.
It appears that after the arrest of the present applicants, custodial interrogation was over and upon perusal of investigation papers, it reflects that the investigation is substantial completed. 9.
In my opinion, no fruitful purpose will be served in case the applicants are detained, particularly for an offence punishable under Section 306 of the Indian Penal Code.
10.
In view of above, it will be appropriate in my opinion to order release of the applicants on following conditions. (I) The applicants be released on bail in Crime No.121/2015 registered on 21st July 2015 at Supa Police Station, District Ahmednagar for the offence, punishable under Sections 306, 342, 323, 504, 506 read with Section 34 of the Indian Penal Code, upon furnishing P.R. Bond of Rs.10,000/- (Rs. Ten thousand) and one surety in the like amount by each of the applicants. (II) The applicants shall keep themselves away from the jurisdiction of Police Station Supa, District Ahmednagar till filing of charge-sheet. 11.
Criminal Application stands disposed of in above terms. ( N.W. SAMBRE, J.) vvr
