Perused the record. It appears that the petitioners have challenged the order dated 01.08.2013 passed by the learned District Judge-1, Dhule, in Misc. Civil Appeal No. 34 of 2013, whereby he allowed the application Exh. 5 filed by the plaintiff in Regular Civil Suit No. 126 of 2013.

Learned Advocate appearing for the petitioners has tendered a copy of the order dated 17.04.2015 passed below Exh.-1, in Regular Civil Suit No. 126 of 2013. The same is taken on record and marked as "X" for identification purposes. Hence, he submitted that the matter becomes infructuous and urged the disposal of the same.

On perusal of the said order as well as the case status of Regular Civil Suit No. 126 of 2013, on C.M.I.S., it is revealed that the Regular Civil Suit bearing No. 126 of 2013 was dismissed in default on 17.04.2015.

In view of the same, the petition is disposed of as infructuous.
