This is an application seeking condonation of delay caused in filing the First Appeal. The State resisted on the point that the delay is huge for which no sufficient explanation has been canvassed. The applicant primarily contended that they have received the amount on 04.08.2021 and therefore due to poverty and illiteracy they were not in a position to arrange Court fees and to engage advocate for filing appeal.

Considering the nature of litigation and the reasons canvassed, the delay stands condoned subject to applicants are not entitled for interest for the delayed period and any other statutory benefits for the said period. 03.

The application stands disposed of.
