The applicant prays for condonation of delay of 998 days caused in filing this civil application for seeking restoration of the writ petition which was dismissed in default by order dated 07.09.2012 on account of failure to pay Bhatta. 2.

The learned Counsel for the applicant has taken me through the reasons set out in the application. The learned AGP S.S.DESHPANDE 1 / 2

4.CA.11971.15.doc opposes the application on the ground that the reasons cited are not satisfactory. In the alternative, he submits that the costs may be imposed by the Court in allowing the civil application and the said cost to be deposited with the Advocate Associations' Bar Library, High Court, Aurangabad.

In the light of the above and for the reasons set out in the application, same is allowed. Delay of 998 days is condoned subject to cost of Rs.1,000/- to be deposited with the Advocate Associations' Bar Library, High Court, Aurangabad within a period of two weeks from today. After depositing the cost, the writ petition shall stand restored.

Needless to state if the above directions are not complied with, this civil application shall stand rejected and the order dated 07.09.2012 dismissing the petition shall stand restored. (RAVINDRA V. GHUGE, J.) S.S.DESHPANDE 2 / 2
