IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 914 WRIT PETITION NO.8482 OF 2020 BABASAHEB MARUTI YEWALE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr. Yogesh Kale h/f Mr. Karpe Rahul R. AGP for Respondents/State: Mr. P. K. Lakhotiya Advocate for Respondent No.2: Mr. A. B. Kadethankar ...

CORAM : S. V. GANGAPURWALA & SHRIKANT D. KULKARNI, JJ.

DATE : 22.12.2020 P.C. :

.

Learned counsel for the petitioners submits that the objection raised by the petitioners is not considered by the respondents in its proper perspective. On 02.12.2020, the petitioners raised an objection to the voters list. Prior to that also on 20.01.2020 the objection was raised with the names of the voters whose names have been illegally included. Many of the voters have migrated still their names are included in the voters list. Some of the voters are dead still their names appear in the voters list. The respondents can take corrective steps even today.

914-WP-8482-2020.odt 2.

We have heard Mr. Kadetahankar for the State Election Commissioner and learned AGP for the respondents/State. 3.

The election program is declared on 15.12.2020. The objection to the provisional voters list was to be raised between 01.12.2020 to 07.12.2020. The petitioners filed an objection on 02.12.2020. The objection was too vague inasmuch as it could be. No details were given of persons who have migrated and/or the persons who are dead. In absence of the detailed objection, it would not be appropriate to entertain the petition. The objections raised in January 2020 may not be of much avail. The cut off date for inclusion of names in the voters list is the valid Vidhan Sabha voters list as on 25.09.2020. The nomination papers are to be filled in from 23.12.2020.

4.

At this stage, it would not be appropriate to interfere with election process.

5.

In light of the above, writ petition is disposed of. No costs.
