By this application, applicant intends to get the delay of 1195 days in filing criminal appeal condoned.

Heard learned Advocate Mr. M. P. Kale and learned APP Ms. V. S. Choudhary for respondent - State.

The present applicant has been convicted by the learned Special Judge / Additional Sessions Judge, Bhokar in Special POCSO Case No.06 of 2015 on 01-07-2017. He has been convicted for the offence punishable under Sections 376(2)(i) and 376(D) of Indian Penal Code and and Section 5(g) (1)

917-Appln-2377-2020.odt punishable under Section 6 of the Protection of Children from Sexual Offence Act and as Section 376(D) is graver offence, he is sentenced to suffer rigorous imprisonment for a period of 20 years and to pay fine of Rs.2,000/-, in default, to suffer further simple imprisonment for two months. 5.

The applicant submits that he is in jail since beginning and could not make arrangements to file appeal. His family members are illiterate. 6.

Taking into consideration the reasons, those have been mentioned in paragraph No.4, the delay stands condoned.
