At the behest of the present applicant, C.R. No.25 of 2015 is registered with Pimpaldari police station, for offences punishable under sections 324, 323, 504, 506 read with sec. 34 of the Indian Penal Code, against the complainant in C.R. No.26 of 2015. C.R. No.26 of 2015 is registered with the said police station for offences punishable under sections 307, 325, 324, 143, 147, 148, 34 of the Indian Penal Code, in which the applicant herein is shown to have been an accused, against whom the sweeping allegations of use of stick in the commission of crime are made.

Learned Addl. Public Prosecutor appearing on behalf of the respondents has opposed the application, on the ground that there are eye-witnesses to the incident, who have stated that the applicant has

(2) criap4741.15 participated in the commission of crime in question by using stick. 3.

Having considered the contents of both the first information reports, i.e. in C.R. No.25 of 2015 and C.R. No.26 of 2015 and sweeping role attributed to each of the accused, it will be appropriate to grant prearrest bail to the applicant herein. Hence, following order :- In the event of arrest of the applicant, in connection with C.R. No.26 of 2015, registered with Pimpaldari police station, for offences punishable under sections 307, 325, 324, 143, 148 read with sec. 34 of the Indian Penal Code, he be released on interim bail, on furnishing P.R. Bond of Rs.10,000/- with one surety for the like amount. The applicant shall attend the concerned police station as and when called by the Investigating Officer. The applicant shall keep himself away from the jurisdiction of the concerned police station, save and except for the investigation purpose, till filing of the charge-sheet.
