1] Heard learned counsel for the applicant. Despite service of notice, none appears for the respondent Nos. 1 and 2. 2] This is an application for condonation of 35 days delay in filing first appeal against the impugned judgment and award passed by the learned Tribunal in MACP no. 262 of 2013. It has been contended that the delay is not intentional and deliberate but caused due to unavoidable circumstances. The appellant is the original claimant seeking compensation for the injuries sustained to her in the vehicular accident. In view of nature of subject matter, there is no impediment to condone the delay. Accordingly application stands allowed in terms of prayer clause (B) Registry to take steps for further process. After registration of appeal, issue notice to respondents returnable on 14.12.2017. Civil application is accordingly disposed of.
