We have heard Mr. Bondar, learned counsel for the petitioner. 2.

Mr. Tambe, learned A.G.P. on instructions submits that the matter is now kept on 22.01.2021 before the Commissioner of State Excise, Maharashtra State, Mumbai. The Commissioner of State Excise would decide the appeal in which stay has been granted against the petitioner within a period of six (06) weeks.

The Statement is accepted. Naturally, the Commissioner of State Excise shall consider all the contentions raised by the appellant before him and the respondents on its own merits and in accordance with law. 4.
