Heard learned counsel for the applicant. The respondent despite service, remained absent.

The applicant is seeking transfer of Marriage Petition No.A397 of 2022 fled by respondent husband for restitution of conjugal right from Family Court Aurangabad to Family Court, Osmanabad. 3.

According to the applicant she is not having any independent source of income and she has to maintain four years child. As such, considering the convenience of applicant-wife, following order.

ORDER

(i) The application is hereby allowed.

(ii) The Marriage Petition No.A-397 of 2022 pending in Family Court, Aurangabad is transferred to the Family Court, Osmanabad for its disposal according to law.

2 956 mca 251-22 (iii) The respondent is directed to appear before the Family Court, Osmanabad on or before 25/01/2023.
