The applicants are seeking regular bail in connection with Crime No. 102/2015, registered with Naldurg Police Station, District Osmanabad for the offence punishable under Sections 143, 147, 148, 149, 326, 323, 504 of the Indian Penal Code, under Section 4/25 of the Arms Act and under Section 135 of the Bombay Police Act.

The perusal of the First Information Report and investigation papers reflect that but for the allegations of use of stick and fist blows, there are no serious allegations against the applicants who are behind the bars since 21/07/2015.

The application is opposed by learned A.P.P. on the ground that the investigation is still in progress. However, looking to the nature of the accusation, I am inclined to grant bail to the applicants. Hence, I propose to pass the following order :- The applicants be released on bail, upon executing the P.R. bond of Rs.15,000/- (Rs. Ten thousand) with one surety in the like amount, by each of them, in connection with Crime No. 102/2015, registered with Naldurg Police Station, District Osmanabad for the offence punishable under Sections 143, 147, 148, 149, 326, 323, 504 of the Indian Penal Code, under Section 4/25 of the Arms Act and under Section 135 of the Bombay Police Act. Till filing of the charge sheet, the applicants shall keep themselves away from the jurisdiction of the concerned police station, but for the investigation purpose.
