The present petition has been filed for direction to respondent No.2 to correct the caste of the petitioner as 'Shimpi' instead of 'Chattri' in his school record.

We do not go much into the facts of the matter along with the application, it appears that caste certificate has also been presented before the respondent No.2. Respondent No. 2 rejected the application solely on the ground that the petitioner is not still taking education in the school, and therefore, the application is not maintainable under Rule 26.4 of the Secondary Schools Code (S.S. Code).

The learned Advocate relies on the decision in Janabai D/o Himmatrao Thakur v. The State of Maharashtra and Others, a Full Bench decision in Writ Petition No. 8085 of 2017, decided on 17.10.2019, wherein it is held that such an application is maintainable and it would be within the said rules.
