DATED : 2 nd February, 2015 PER COURT :- 1] Shri V.D.Godbharle, learned Additional Public Prosecutor submits that by the present Revision Application the challenge is to the order passed by the learned Assistant Sessions Judge, Sangamner on 2.7.2014, by which the learned Assistant Sessions Judge, Sangamner has passed the order of discharge of respondent nos. 1 to 4.

2] In view of Section 10 of the Code of Criminal Procedure, a Assistant Sessions Judge is subordinate to Sessions Judge. In that view of the

crra209.14 matter the present Revision ought to have presented before the Sessions Judge.

3] Hence, present Revision is disposed off as Revision will lie before Sessions Judge. However, liberty is granted to Applicant/State to approach to the Sessions Court.
