The petitioner has already availed the remedy by filing an Appeal against the order of the penalty and for release of the vehicle. When the Appeal is already pending, writ petition for the same relief would not be tenable.

The Authority where the Appeal is filed shall consider the application of the petitioner for release of the vehicle and the Appeal on its own merits and take decision within a period of one month.

Writ Petition is disposed of. No costs.
