This is an application under section 439 (2) of the Code of Criminal Procedure, seeking cancellation of bail granted to respondent no.2 by Additional Sessions Judge, Bhokar, vide order dated 26th August, 2015, passed in Misc. Criminal Application No.95 of 2015. 2.

Learned Counsel appearing on behalf of the applicant, while trying to make out a case for cancellation of bail, would urge that in view of chit that was found in the handwriting and signature of the victim, strong evidence was available against respondent no.2 and as such, bail ought not to have been granted to him.

In view of law laid down by the Apex Court, in the matter of Siddharam Satlingppa Mhetre vs. State of Maharashtra & ors., reported in (2011) 1 SCC 694, learned Additional Sessions Judge was right in granting the bail. In view thereof, no case for interference is made out. Thus, the Criminal Application fails and stands rejected. (N.W. SAMBRE, J.) amj
