The applicant is seeking pre-arrest bail in connection with Crime No. 605/2021 registered with Kotwali Police Station, District Ahmednagar for the offences punishable under Sections 307, 341, 143, 147, 148, 149, 323, 504, 506, 427 of the Indian Penal Code (for short "IPC") and section 4/25 of the Indian Arms Act. 2.

The first information report (FIR) was registered on 18.08.2021 alleging that cousin of complainant was assaulted by the accused. Coaccused Chaitanya Gadalkar assaulted by sickle on the head of the injured and the applicant had allegedly assaulted by fighter causing simple injury on the backside of left hand of the complainant. 3.

Interim protection was granted to the applicant by this Court vide order dated 12th October, 2021 with direction to attend the Investigating Officer.

Learned counsel for the applicant submitted that co-accused Chaitnya Gadalkar and Rushabh Lodha were arrested and they have been granted bail. The applicant had complied the directions of reporting to the Investigating Officer and the fighter has been handed over to him. This fact is confirmed by the learned A.P.P. on instructions. 5.

Considering the aforesaid circumstance, the interim protection granted to the applicant can be confirmed. Hence, I pass the following order :-

O R D E R

i.

Anticipatory Bail Application No. 1168 of 2021 is allowed. ii.

Interim relief granted to the applicant vide order dated 12th October, 2021 is confirmed.

iii.

In the event of arrest of the applicant in Crime No. 605/2021 registered with Kotwali Police Station, District Ahmednagar, the applicant shall be released on bail on executing P. R. Bond of Rs.25,000/- with one or more sureties in the like amount. iv.

The applicant shall appear before the investigating officer as and when called for till filing of the charge sheet. (PRAKASH D. NAIK, J.) JPC
