Advocate Mr. Bajaj the learned counsel appearing for the Petitioners submits that on 18.05.2024 RCS No.516/2015 was finally adjudicated by the learned 6th Jt. C.J.S.D., Ahmednagar. Challenge in the petition to the order dated 05.07.2023, whereby the additional issue on the point of res judicata was framed. Therefore, the petition has become infructuous. However, the Petitioners seek liberty to raise additional ground in the appeal in respect of framing the additional issue of res judicata. 2.
