The learned counsel for the petitioner submits that the notice is issued under Section 48(7) & (8) of the Act as to why the penalty should not be imposed on the vehicle of the petitioner i.e. the Tipper when the matter is pending before the concerned authority.

The petitioner if advised to give response to the notice and get it adjudicated before the concerned authority. The concerned authority is directed to decide the same expeditiously. 4.
