The learned Advocate for the Applicants, on instructions, seeks leave to withdraw the Application to the extent of the Applicant No.2 - Bhanudas Motiram Puyad and the Applicant No.3 - Sanjay Govindrao Puyad with liberty to file afresh after expiry of six (6) months.

This is the successive Application for Suspension of Sentence and Bail by the Applicant No.1, who was Accused No.1 before the learned Trial Court. He has been convicted for the offence punishable under Section 307 of the Indian Penal Code (for short, 'I.P.C.') and sentenced to suffer 07 (Seven) years Rigorous Imprisonment and fine of

Rs.50,000/- (Rs. Fifty Thousand Only), in default, to suffer Rigorous Imprisonment of 01 (one) year; for the offence under Section 326 r/w. 34 of the I.P.C. sentenced to suffer 05 (five) years Rigorous Imprisonment and fine of Rs.10,000/- (Rs. Ten Thousand Only), in default, to suffer Rigorous Imprisonment of 06 (six) months; and for the offence under Section 324 r/w. 34 of the I.P.C., sentenced to suffer Rigorous Imprisonment of 01 (one) year.

It is submitted by the learned Advocate for the Applicant No.1 that, the Applicant No.1 would be completing half of the term sentence in next couple of months and there is no possibility that, the Appeal would be heard in the near future and therefore, the Application be allowed. He further submits that, the Applicant No.1 is ready to abide any conditions which would be imposed by this Court in the Application. 4.

The Application is vehemently opposed by the learned APP and the learned Advocate for Assist to P.P. They submit that, earlier Application filed by the Applicant No.1 along with Co-accused was considered and rejected on merits by this Court and therefore, this second Application cannot be considered on merits. They submit that, there are two (2) months left to be completed half the term sentence of the Applicant No.1. They submit that, the Application be rejected. 5.

Considered the above submissions of both the sides. The Appeal

is of 2024. Though the contention that Private Paper-Book can be made available, the Applicant No.1 has completed almost half of the term sentence less two months. There is no possibility that the Appeal would be heard finally in the near future as there is Appeal preferred by the State as well as by the Victim for enhancement of the sentence which is before the Division Bench of this Court. It is informed that the Record and Proceedings are not received. There is no dispute that, no leave is granted in the said Appeal. In these facts and circumstances of the case, I am inclined to allow the Application. Hence, the following order.

ORDER

(i) The Application stands disposed off as withdrawn to the extent of the Applicant No.2 - Bhanudas Motiram Puyad and the Applicant No.3 - Sanjay Govindrao Puyad, with liberty to file afresh after a period of six

(6) months.

(ii) The substantive Sentence imposed by the learned Additional Sessions Judge-3, Nanded in Sessions Case No.177/2022 vide Judgment and Order dated 22.08.2024 on the Applicant No.1, by name, Ranjit Bhanudas Puyad for the offence punishable under Sections 307, 326 r/w. 34 and 324 r/w. 34 of the IPC, is suspended during pendency of the Appeal.

(iii) Applicant No.1 - Ranjit Bhanudas Puyad be released on bail on furnishing P. R. Bond of Rs.15,000/- (Rupees Fifteen Thousand Only), with one surety in the like amount.

(iv) The Applicant No.1 - Ranjit Bhanudas Puyad shall attend the Nanded Rural Police Station, Nanded, Tq & Dist. Nanded once in a month on the last Thursday between 12:00 p.m. to 02:00 p.m., until further orders.

(v) Bail before the Trial Court.

Application stands disposed off accordingly.
