The applicants claimants are seeking permission to bring legal heirs of deceased respondent No.6 by condoning the delay of 1135 days.

Admittedly, original respondent No.6 has died on 06/05/2019 as per the death certifcate annexed. Though there is delay, but considering the right to defend, the application is required to be allowed. Accordingly, the application is allowed in terms of prayer clause - B by condoning the delay of 1135 days. 3.
