PER COURT :- The petitioner is objecting to selection of respondent No.3 for award of dealership of retail sale of petroleum products by respondent No.2.
It is point out that since there are criminal cases pending against the concerned respondent and that he is alleged to have committed an offence involving moral turpitude/economic offences, he is not entitled to be considered for appointment as a dealer. The objection raised by the petitioner in that behalf has been turned down by the Grievance Cell, relying upon paragraph No.10 (A) (ii) of the Information Brochure, 1014. Disqualification is attracted in case of conviction of the applicant and not merely on account of pendency of criminal cases. No case is made out for holding respondent No.3 disqualified even prima fracie. The writ petition is devoid of substance and hence stands dismissed.
