903 WRIT PETITION NO. 9117 OF 2016 SHAIKH MUSTAFA MOIN

VERSUS

THE STATE ELECTION COMMISSION NEW ADMINISTRATIVE BUILDING MUMBAI AND OTHERS ...

Advocate for Petitioner : Mr. M.P. Kale AGP for Respondents:Mr. S.B. Pulkundwar ...

CORAM : R. M. BORDE & K. K. SONAWANE, JJ.

Date: September 28, 2016 ...

PER COURT :- The petitioner is praying for transfer of approximately 150 voters from ward No.4 to ward No.3 of the Municipal Council, Gangakhed.

The voting population of ward No.3 is 3749; whereas the voting population of ward No.4 is 4157. Thus, there is a difference of 10% in the number of voters in both the wards, which is in consonance with the relevant Rules.

The grievance raised by the petitioner in the instant petition, need not be entertained in exercise of extraordinary jurisdiction under article 226 of the Constitution of India. The petition is devoid of substance and hence stands rejected.
